4% promotion quota for staff with benchmark disabilities

  NEW DELHI: The department of personnel and training (DoPT)  on Tuesday notified the policy on reservation in promotion  to persons with benchmark disabilities (PwBDs) in central  government posts, fixing 4% of total vacancies in the cadre  strength within Group C, from Group C to Group B, within  Group B and from Group B to lowest rung of Group A, for  PwBDs.
The DoPT’s instructions — which are in deference   to the Supreme Court direction dated September 28, 2021  in the ‘Siddaraju vs State of Karnataka’ case — state  reservation in promotion shall be applicable in the  cadres in which the element of direct recruitment does not  exceed 75%.
Against the posts identified for each disability, 1% each shall be reserved for PwBDs with disabilities like blindness and low vision,deaf and hard of hearing, locomotor disability including cerebral palsy, leprosycured, dwarfism, acid attack victims and muscular dystrophy; and 1% combined  for persons with autism, intellectual disability, specific learning disability, mental illness and deaf-blindness.
Benchmark disability refers to having at least 40% disability of any type recognised under the Rights of Persons with Disabilities Act, 2016.
The authenticity of any certificate, issued by a competent medical authority, may be verified or re-verified by the appointing authority at the time of appointment.
As per the DoPT instructions, any government department may  seek exemption of an establishment from the provision of reservation for PwBDs, but would need to make a prior reference to the department of empowerment of persons with disabilities (DEPwD), giving full justification for making the proposal. The DEPwD may, having regard to the type of work carried out in any government establishment and in consultation with the Chief Commissioner for Persons with Disabilities (CCPD), agree to a partial or full exemption. 
As per the provisions of the Rights of Persons with Disabilities Act, 2016, no promotion shall be denied to a person merely on the ground of disability and no government  establishment shall dispense with or reduce in rank an employee who acquires a disability during his/her service.
