40-year-old Visually Impaired Woman Argues Own Court Case

KOCHI: She had never had light before her eyes; but led by her inner light, she fought for her right to win. The Kerala High Court on Wednesday witnessed a rare fight for justice, when a 40-year-old visually challenged woman argued her own case before the court against the Kannur University decision denying her appointment to the post of lecturer in law.

E S Prasanna Kumari, of Chottanikkara, was an applicant to the post of lecturer in law called under the vacancy and reservation quota for physically handicapped as per the notification issued by the Kannur University on 2008.

 

If nobody turned up for a vacancy reserved for physically challenged, candidates from other eligible categories could be considered, Prasanna submitted.

The notification had stated that the age of the candidate as on January 1, 2008, should be 40 years. However, there was an exemption for the physically challenged candidates.

Pursuant to a memo issued by Kannur University she appeared for an interview on October 5, 2010.

During the interview, an issue was raised by the board on age and informed that she was permitted to appear for the interview on a provisional basis.

However, even one year after the interview, no correspondence was sent to her.

She later filed an RTI application and received a reply that another applicant Kavitha Balakrishnan was appointed on December 21, 2011.

Prasanna sought a directive to quash the appointment and direct the university to consider her for the post. Justice A K Jayasankaran Nambiar has adjourned the hearing of the case.
