HC Nod For Appointment of Visually Impaired

KOCHI:  A Division Bench of the Kerala High Court on Monday upheld a Single Bench order directing the Kannur University to consider Prasanna Kumary, a visually impaired woman, for appointment as Lecturer in Law.

The Bench comprising Justice Antony Dominic and Justice Shaji P Chaly passed the order while dismissing an appeal filed by the Kannur University, challenging the Single Judge order. The court also dismissed an appeal filed by Kavitha Balakrishnan of Kozhikode, challenging the Single Bench order declaring her appointment illegal.

Prasanna Kumary of Chottanikkara had applied for the post of Lecturer in Law, under the reservation quota for physically handicapped persons, as per a notification issued by the Kannur University on November 29, 2008.

The age limit for the post was 40 as on January 2008. The petitioner attended an interview on October 5, 2010, but the interview board raised objection to her age, stating that she had exceeded the prescribed age limit. She pointed out that she was entitled to the benefit of age relaxation contemplated for the physically handicapped.The Single Judge had held that the  university’s action of not considering the petitioner for the post reserved for physically handicapped was illegal.

The Division Bench declined to interfere in the order.
